Terms of Service

1. Parties and Scope
These Terms of Service ("Terms") govern the relationship between restaurant operators ("Operator") and customers making reservations ("End User") who use the checkrezerve application, and the application owner. By starting to use the Application, you are deemed to have accepted these Terms.
2. Service Description
checkrezerve is a web application providing reservation management, administration and notification services tailored for restaurants. AI-powered message analysis, SMS/WhatsApp notifications and the admin/restaurant panel are within the scope of this service.
3. Account Security
- Restaurant and admin account passwords must be kept confidential.
- You must notify us immediately if you detect unauthorised access to your account.
- Sharing account credentials with third parties is prohibited.
4. Acceptable Use
The following uses are strictly prohibited:
- Creating fraudulent reservations.
- Attempting to gain unauthorised access to or damage the system.
- Sending notifications for spam purposes.
- Sharing customer data with unauthorised third parties.
- Activities contrary to the Turkish Penal Code and relevant legislation.
5. Data Responsibility
The Operator is obliged to process the customer data it collects (name, phone, reservation details) in accordance with applicable data protection law. checkrezerve provides the technical infrastructure on behalf of the Operator; the Operator is responsible for the lawful use of the data.
6. Customer Notifications
The system may send SMS or WhatsApp messages to the customer's phone number for reservation confirmation and reminder messages. Customers are deemed to have given implicit consent to this communication through the reservation form. Recording consent is the Operator's responsibility.
7. Artificial Intelligence (AI) Use
The AI feature forwards messages to the Anthropic API for the purpose of extracting reservation information through message analysis. Messages are not stored by Anthropic (zero data retention policy). AI analysis results are advisory in nature; user verification is recommended.
8. Service Continuity and Limitation of Liability
checkrezerve does not guarantee uninterrupted service. Planned maintenance is announced in advance. Maximum liability for indirect damages arising from system errors (lost reservations, customer loss, etc.) is limited to the monthly fee for the month in which the service was used.
9. Intellectual Property
The application software, interface and branding elements belong to checkrezerve. Unauthorised copying, distribution or creation of derivative works is prohibited.
10. Termination
In the event of a breach of these Terms, the account may be suspended or deleted. The Operator may close their account by giving 30 days' written notice. Following closure, data will be deleted within 30 days, subject to legal obligations.
11. Changes
Significant changes to the Terms will be announced 15 days in advance by email or application notification. Continued use following a change constitutes acceptance.
12. Governing Law and Jurisdiction
These Terms are subject to Turkish Law. Istanbul Courts and Enforcement Offices have jurisdiction over any disputes.
